These Terms and Conditions ("Terms") govern the use of the McVay Automations website and services. By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services

McVay Automations provides services including, but not limited to, website design, AI chatbots, business automations, integrations, and related consulting services. All services are provided as outlined in individual proposals, agreements, or invoices.

We reserve the right to modify or discontinue any service at any time.

2. Client Responsibilities

Clients agree to:

  • Provide accurate and complete information required to deliver services

  • Respond in a timely manner to requests for approvals, content, or feedback

  • Ensure they have the legal right to use any content, images, or data they provide

McVay Automations is not responsible for delays or issues caused by incomplete or inaccurate client information.

3. Payments and Billing

All fees are outlined in the agreed proposal, invoice, or payment link.

  • Setup fees are one-time and non-refundable once work has begun

  • Monthly services are billed on a recurring basis

  • Late or failed payments may result in suspension of services

  • Prices are subject to change with notice

Clients are responsible for any third-party software or platform fees unless otherwise stated.

4. No Guarantees

While McVay Automations strives to improve efficiency, lead capture, and online presence, we do not guarantee specific business results, revenue increases, or conversion rates.

All services are provided "as is" and results may vary depending on factors outside our control.

5. Intellectual Property

Upon full payment, clients receive rights to use the deliverables created specifically for them. McVay Automations retains the right to display work for portfolio, marketing, or demonstration purposes unless otherwise agreed in writing.

Any tools, templates, code frameworks, or systems developed prior to or outside a specific project remain the property of McVay Automations.

6. Third-Party Services

Our services may rely on third-party platforms such as hosting providers, automation tools, chatbot platforms, payment processors, or APIs. McVay Automations is not responsible for outages, changes, or limitations caused by third-party services.

Clients agree to comply with the terms of any third-party services used.

7. Data and Privacy

McVay Automations may collect and process limited data necessary to deliver services. We take reasonable steps to protect client data but cannot guarantee absolute security.

Clients are responsible for ensuring compliance with any data protection laws applicable to their business.

8. Termination

Either party may terminate services with written notice, subject to any agreed notice period.

Upon termination:

  • Outstanding balances remain due

  • Access to services may be revoked

  • Refunds are given up to a week after services is given

9. Limitation of Liability

To the fullest extent permitted by law, McVay Automations shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount paid by the client for services in the three months prior to the claim.

10. Changes to Terms

McVay Automations may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.
